Many employers want to do more to alleviate barriers, but with <a href=\"https:\/\/www.cnbc.com\/2022\/07\/13\/inflation-rose-9point1percent-in-june-even-more-than-expected-as-price-pressures-intensify.html\">rising costs in both goods and services<\/a>, <a href=\"https:\/\/www.aflac.com\/docs\/awr\/pdf\/2020-trends-and-topics\/Employer-Trend-4-Cost-greatest-barrier-for-employers-to-offer-benefits.pdf\">it is often too costly<\/a> to change policies without some sort of financial offset. Many people who are overlooked or underemployed, including \u201c<a href=\"https:\/\/dev.workmorphis.com\/resources\/workmorphis-hidden-worker-series\">hidden workers<\/a>,\u201d are either waiting for the right opportunity or have left the job market entirely, making it even more essential to address barriers that will unlock access to more job seekers. &nbsp;<\/p>\n\n\n\n<p>While there are many government incentives available to employers, the public workforce system can feel like a churning sea of unmapped waters. Workmorphis helps employers navigate this essential policy area by connecting them with the resources they need.<\/p>\n\n\n\n<p>The federal <a href=\"https:\/\/www.dol.gov\/agencies\/eta\/wotc\">Work Opportunity Tax Credit (WOTC)<\/a> was created to help alleviate some of the cost burdens faced by employers when hiring by creating savings that they can reinvest in their employees. This means the WOTC has the added benefit of creating economic mobility for workers from non-traditional pathways.<\/p>\n\n\n\n<p><strong>What is the WOTC?<\/strong><\/p>\n\n\n\n<p>Established as a temporary program in 1985 and made permanent by a bipartisan bill in 2019, the WOTC was designed to incentivize employers to consider overlooked recruits from non-traditional employment pathways. <a href=\"https:\/\/www.ncsl.org\/documents\/Task_forces\/Assessing_The_Work_Opportunity_Tax_Credit.pdf\">Reports such as this from the National Conference of State Legislatures (NCSL)<\/a> have found that WOTC not only \u201cappears to be among the most effective\u2014for some analysts the most effective\u2014labor market policy for getting individuals into jobs,\u201d but also that the program may pay for itself and then some because of economic gains from employing overlooked workers and low costs. However, there is some evidence that the program is underutilized with some analysts arguing that the government should implement more <a href=\"https:\/\/www.niskanencenter.org\/wp-content\/uploads\/2022\/03\/Less-Paperwork-Higher-Wages-2.pdf\">direct employment subsidies<\/a> to encourage employer buy-in.<\/p>\n\n\n\n<p>Regardless, the WOTC is an incentive that your company can leverage <strong><em>right now<\/em><\/strong> to both attract new talent and create economic mobility for workers and their families. Populations who may be eligible for WOTC include:<\/p>\n\n\n\n<ul><li>Veterans<\/li><li>Long-term unemployed workers (more than 27 consecutive weeks)<\/li><li>Formerly incarcerated and returning citizens, and\/or those convicted of a felony<\/li><li>Individuals referred from a rehabilitation program<\/li><li>Persons with disabilities<\/li><li>Summer youth employees<\/li><li>Temporary Assistance for Needy Families (TANF) recipients<\/li><li>Supplemental Nutrition Assistance Program (SNAP) recipients<\/li><li>Supplemental Security Income (SSI) recipients<\/li><li>Residents of designated rural or \u201cempowerment\u201d zones<\/li><\/ul>\n\n\n\n<p>Please note that there may be additional qualifications for these individuals to be WOTC eligible. What do I need to know for compliance?<\/strong><\/p>\n\n\n\n<p>WOTC is a non-refundable tax credit, meaning the incentive reduces your federal tax burden rather than paying you directly. An employer can receive a tax credit worth 25% to 40% of an employee\u2019s wages in their first year of employment for a total incentive of up to $9,600. The <a href=\"https:\/\/www.cmswotc.com\/work-opportunity-tax-credit-wotc-statistics-2020\/\">average incentive per employee is around $2,400<\/a>.<\/p>\n\n\n\n<p>Awards are <a href=\"https:\/\/demo.gethired.com\/wotc-estimate-calculator\/\">calculated on a sliding scale<\/a> based on the wage of the individual hired and retained, the number of hours worked, and the target population from which the worker identifies. As a result, this credit alleviates some of the risk associated with new hiring, thereby allowing employers to offer more competitive wages and benefits.<\/p>\n\n\n\n<p>Employers have 28 days from the new hire\u2019s start date to file. Retroactive applications are forbidden, so it is important to plan in advance and build paperwork into the new hire packet before onboarding. If you\u2019re concerned about compliance or anti-bias laws, <a href=\"https:\/\/www.shrm.org\/resourcesandtools\/legal-and-compliance\/employment-law\/pages\/eeoc-says-anti-bias-laws-do-not-block-employers-from-using-wotc-.aspx\">the Equal Employment Opportunity Commission (EEOC) has assured employers<\/a> that using the necessary <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-8850\">IRS Form 8850<\/a> will help you avoid running afoul of any laws.<\/p>\n\n\n\n<p>Work alongside your HR team to ensure that you are capturing the necessary information while keeping paperwork federally compliant and inclusive.<\/p>\n\n\n\n<p><strong>I\u2019m an overlooked worker entering or reentering the workforce. What does the WOTC look like for me if I find a job?<\/strong><\/p>\n\n\n\n<p>If your new employer chooses to apply for WOTC, they can offer you paperwork to confirm your eligibility. Per federal guidance, this paperwork should include the <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-8850\">IRS Form 8850<\/a>. By law, the <a href=\"https:\/\/www.cmswotc.com\/can-an-employer-make-the-wotc-form-mandatory\/\">employer cannot compel you to fill out the paperwork<\/a> and all disclosures are voluntary. However, <a href=\"https:\/\/news.bloomberglaw.com\/daily-tax-report\/implications-of-the-work-opportunity-tax-credit-and-labor-market\">case studies have shown that employers who use WOTC often reinvest the savings in higher wages and more benefits<\/a> to stay competitive, as opposed to those who forgo the incentive. This means that it may be in your best interest to self-report if you are comfortable doing so, but keep in mind that you always maintain your right to refuse without penalty.
